Terms of use

These terms govern your access to and use of the DayMarshal website and application. By using DayMarshal, you agree to these terms. If you use DayMarshal for an organization, you confirm that you are authorized to accept these terms for that organization.

The service

DayMarshal organizes information from email, meetings, calendars, and linked chat services into summaries, tasks, decisions, risks, and follow-ups. Features may depend on third-party services and may change as the product develops.

Accounts and access

• You must provide accurate account information and keep your login credentials secure.
• You are responsible for activity performed through your account and for promptly notifying us of suspected unauthorized access.
• Organization owners and administrators control membership and roles within their workspace.
• You may not share access in a way that bypasses account or organization controls.

Meetings, recording, and consent

DayMarshal can send a visible notetaker to a Zoom, Google Meet, or Microsoft Teams call at your request, and can record an in-person meeting through your device microphone after you press Record. You are responsible for having the authority to record, for providing notice, and for obtaining any consent required by applicable recording, privacy, employment, or communications laws. Do not record where it is prohibited or where participants have not agreed.

The notetaker must remain identifiable as “DayMarshal Notetaker.” You must not attempt to conceal it, impersonate another person, or use DayMarshal for surveillance.

Acceptable use

You may not use DayMarshal to:

• break the law, infringe another person’s rights, or process content you are not permitted to use;
• harass, discriminate against, deceive, monitor, or harm another person;
• upload malware, probe security controls, disrupt the service, or gain unauthorized access;
• reverse engineer the service except where applicable law expressly permits it; or
• resell or provide the service to third parties unless we have agreed to that in writing.

Your content

You retain ownership of content you provide to DayMarshal. You grant us a limited right to host, transmit, and process that content only as needed to operate, secure, and improve the service. You are responsible for ensuring that you have the rights and permissions needed to provide the content.

Our handling of personal information is described in the privacy policy and data protection & retention policy.

AI-generated output

Summaries, importance ratings, extracted tasks, and other AI-generated output can be incomplete or incorrect. DayMarshal is a productivity aid, not a substitute for reviewing the underlying email, transcript, or source material. You remain responsible for decisions and actions taken from generated output.

Third-party services

DayMarshal relies on services including Zoom, Attendee, Google, Discord, OpenAI, and hosting providers. Your use of those services may also be governed by their terms. We are not responsible for third-party outages, account restrictions, or changes outside our control.

Availability and changes

We aim to keep DayMarshal available and secure, but we do not promise uninterrupted or error-free service. We may modify, suspend, or discontinue a feature where reasonably necessary, including for security, legal, or operational reasons.

Suspension and termination

You may stop using DayMarshal at any time. We may suspend or terminate access if you materially breach these terms, create a security risk, or use the service unlawfully. Where practical, we will give notice and an opportunity to remedy the issue.

Disclaimers and liability

To the extent permitted by applicable law, DayMarshal is provided “as is” and “as available,” without implied warranties. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities. Nothing in these terms excludes liability that cannot lawfully be excluded or limits mandatory consumer rights.

Changes to these terms

We may update these terms as the service changes. We will update the date above and provide additional notice where required. Continued use after revised terms take effect means you accept them.
